1. Acceptance of Terms

By using CardIQ, you agree to these Terms and our Privacy Policy. These Terms apply to users in USA, Canada, EU, and UK. If you disagree, do not use the App.

2. License & Use

We grant you a limited, personal, non-exclusive licence to use the App, including for your own business or trading activity — pricing your own inventory, for example.

You may NOT

✗ Copy, modify, or reverse engineer the App
✗ Rent, sell, or sublicense the App, or resell access to it
✗ Remove copyright notices
✗ Use bots, scrapers, or automated tools against the App or our servers
✗ Attempt unauthorized access

All content, design, and code are owned by Andrés Felipe Saumet, trading as Alquimia Studio.

3. Anonymous Usage & Data Ownership

CardIQ requires no account. You are identified by an anonymous UUID generated on your device.

Images and metadata are stored locally on your device only
You own all images and can delete them anytime
Local data is deleted when you uninstall the App. What our server and our providers hold is described in the Privacy Policy and is not reached by uninstalling
Portfolio Snapshots: The App stores a daily local record of your collection's estimated value on your device to power the Portfolio Value Tracker. This data never leaves your device.

Data protection roles: for the processing described in the Privacy Policy, Andrés Felipe Saumet, trading as Alquimia Studio, is the data controller. OpenAI, eBay, RevenueCat and Meta act as processors or independent controllers for their own parts, as set out there.

Andrés Felipe Saumet, trading as Alquimia Studio, is NOT responsible for

✗ Device malfunction or data loss
✗ Uninstalling the App
✗ Device compromise or unauthorized access
✗ iCloud/Google Drive backup issues

4. Card Information & Grading Disclaimer

The App provides:

Card identification (OpenAI Vision)
Grade estimates for informational purposes
Price ranges from eBay

CardIQ is not affiliated with or endorsed by PSA, BGS (Beckett), or CGC.

CardIQ provides AI-powered grade estimates for informational purposes only. These are NOT official professional grades. For certified grading, submit your cards to PSA, BGS, or CGC. Actual grades may differ significantly from our estimates.

No guarantee of accuracy

✗ Card identification may be incorrect
✗ Grade estimates differ from professional grading
✗ Prices come from active listings, which are asking prices rather than completed sales, and change rapidly
✗ Price estimates do not distinguish between card variants
✗ eBay listings may be unavailable

Users should

Verify card information independently
Consult professional graders (PSA, Beckett, CGC) for official grades
Cross-reference prices on multiple marketplaces
Not rely solely on the App for valuation, purchase, sale or grading decisions

5. Third-Party Services

CardIQ backend server

Card images are transmitted securely via HTTPS to our own server before being forwarded to OpenAI for analysis
Images are discarded once analysis finishes. We keep no copies and no logs of them
Analysis results are cached for up to 24 hours, and IP addresses are used for abuse limiting and error logs, as described in the Privacy Policy
Server location: United States

OpenAI integration

Our server forwards your card images to OpenAI for analysis
Your images are not used to train OpenAI's models
OpenAI may briefly retain API inputs and outputs for abuse monitoring under its API data policy

eBay integration

Card names are sent to eBay for market prices, by our server using our own credentials

Meta (Facebook) SDK

The App uses the Meta SDK for advertising attribution and campaign measurement
If you grant permission via the iOS App Tracking Transparency (ATT) prompt, your device's advertising identifier (IDFA) may be shared with Meta
If you decline ATT, only anonymous aggregated data is sent via Apple's SKAdNetwork

Third-party trademarks

PSA, BGS (Beckett Grading Services), and CGC are trademarks of their respective owners
CardIQ is not affiliated with, endorsed by, or sponsored by any grading company

Third-party changes

APIs may change or discontinue without notice
We are not liable if third-party services stop working

6. Free Tier & Subscriptions

Free tier

CardIQ is free to download and includes the following one-time limits (not per month — one time, ever):

1 card scan (lifetime)
1 collection created (lifetime)
1 card added to a collection (lifetime)
1 market price refresh (lifetime)

Once any of these limits is reached, a CardIQ Pro subscription is required to continue using that feature. These limits are tracked locally on your device and are reset only if the App is uninstalled.

CardIQ Pro (optional paid subscription)

Subscribing to CardIQ Pro removes those limits and provides:

Up to 25 card scans per day (limit resets at midnight each day); market price refreshes count towards this limit
Unlimited collections
Unlimited cards added to collections

Pricing

CardIQ Pro is offered as weekly, monthly and annual subscriptions. Current prices, including any introductory offer, are shown in the App before you confirm a purchase, in your local currency as set by the App Store. Prices may change; any change applies only to future billing periods and is shown to you before it takes effect.

Subscription terms

Auto-renews unless canceled at least 24 hours before the end of the current billing period
To cancel: iOS Settings → [Your Name] → Subscriptions → CardIQ → Cancel Subscription
Canceling stops future charges but does not refund the current billing period
You retain Pro access until the end of the paid period
Billing is handled by the Apple App Store. RevenueCat manages your subscription status on our behalf and never receives your payment details
Credit card details are NOT stored by us
Refunds subject to Apple App Store policies

7. Prohibited Conduct

You agree NOT to:

✗ Illegal activities or violate any law
✗ Infringe copyrights, trademarks, patents, or IP rights
✗ Hack, crack, or reverse engineer the App
✗ Scrape data or use automated tools against the App or our servers
✗ Collect other people's personal information
✗ Submit malware or malicious code
✗ Harass, threaten, or spam
✗ Circumvent the free tier limits or resell access to the App

Violations may result in suspension, legal action, or law enforcement reporting.

8. Warranty Disclaimer

CardIQ is provided "AS-IS" and "AS-AVAILABLE."

We make NO warranties

✗ Merchantability or fitness for purpose
✗ Non-infringement or accuracy
✗ Uninterrupted or error-free operation
✗ Availability or technical support

The App may

Experience downtime or outages
Change features without notice
Have bugs or errors
Be discontinued entirely
Lack guaranteed support

Nothing in these Terms excludes or limits any statutory rights you may have under applicable mandatory consumer protection law. If you are an EU or UK consumer, you may be entitled to certain warranties and remedies that cannot be excluded by contract.

9. Liability Limitation

We are NOT liable for:

✗ Loss of profits, revenue, data, or use
✗ Business interruption
✗ Consequential, indirect, or punitive damages
✗ Claims even if advised of possibility
✗ Decisions to buy, sell or submit a card for grading made on the basis of the App's estimates

Total Liability Cap: Amount you paid for the App (or $0 if free).

10. Indemnification

You agree to defend and hold Andrés Felipe Saumet, trading as Alquimia Studio, harmless from:

Claims arising from your use of the App
Third-party infringement claims
Violation of these Terms or law
Your content or conduct

11. Termination

By You: Uninstall the App anytime. Local data deletes automatically.

By Us: We may block access from the App to our servers if you:

Violate these Terms
Infringe IP rights
Engage in illegal activity
Require it for operational reasons

Upon Termination: License revoked, local data deleted on uninstall, liability survives.

12. Privacy Policy

Your privacy is governed by our separate Privacy Policy. Key points:

✓ Minimal data collection (anonymous UUID, IP address)
✓ No data sales. One narrow advertising exception, only if you grant the ATT permission
✓ Your cards and collections stay on your device
✓ Rights to access, deletion and objection
✓ GDPR, CCPA, UK GDPR, PIPEDA compliant

13. Modifications

We may modify these Terms at any time. Changes announced in-app with updated dates. Continued use = acceptance.

14. Governing Law & Jurisdiction

Primary Jurisdiction: These Terms are governed by the laws of the Republic of Colombia, where the operator is based, without regard to conflict of law provisions.

The following mandatory protections apply regardless:

USA Residents: California law applies; CCPA if California resident
EU Residents: Mandatory EU consumer protection laws apply, including the right to bring proceedings in the courts of your country of residence; GDPR applies
UK Residents: Consumer Rights Act 2015 and UK GDPR apply
Canadian Residents: Ontario law applies; PIPEDA applies

Dispute resolution

Attempt informal resolution via email first
Provide written notice with details
Give us 30 days to respond
Attempt good-faith negotiation
If unresolved, either party may pursue legal action in a competent court

15. USA-Specific Provisions

CCPA (California): See Privacy Policy for CCPA rights
Consumer Rights: We aim to comply with the California Consumer Legal Remedies Act
Accessibility: We aim to follow WCAG 2.1 AA guidance. If you encounter a barrier, contact andressaumet@gmail.com and we will try to address it

16. EU-Specific Provisions

Consumer Rights: EU Directive 2011/83/EU applies
Liability: Cannot exclude liability for death, personal injury, fraud, or statutory guarantees

17. UK-Specific Provisions

Consumer Rights Act 2015: Applies to digital content quality and updates
UK GDPR: See Privacy Policy for UK GDPR rights

18. Canadian-Specific Provisions

Consumer Protection: Complies with provincial laws (Ontario, Alberta, BC)

19. Apple App Store Terms

These Terms are between you and Andrés Felipe Saumet, trading as Alquimia Studio, and not with Apple. Apple is not responsible for CardIQ or its content.

Scope of licence: the licence granted to you is limited to a non-transferable licence to use CardIQ on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Maintenance and support: we are solely responsible for providing any maintenance and support for CardIQ. Apple has no obligation whatsoever to furnish any maintenance or support services.
Warranty: to the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to CardIQ. If CardIQ fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, paid for the app. Beyond that, Apple has no other warranty obligation whatsoever.
Product claims: we, not Apple, are responsible for addressing any claims relating to CardIQ or your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
Intellectual property claims: if a third party claims that CardIQ or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
Legal compliance: you represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Andrés Felipe Saumet, trading as Alquimia Studio. These Terms supersede all prior agreements.

22. Severability

If a provision is unenforceable:

EU/UK: Court may modify to make enforceable
USA/Canada: Provision severed entirely
All other provisions remain in effect
