⚖️ Agreement to Terms

By downloading, accessing, or using ClearSpace ("App," "we," "us," "our"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the App.

1. License & Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use ClearSpace for personal, non-commercial purposes only. You may not:

• Reverse engineer, decompile, or modify the App
• Copy or distribute any part of the App
• Use the App for commercial purposes
• Violate any laws or regulations
• Share your subscription with others

2. Subscription & Billing

ClearSpace offers paid subscription options only. The App does not provide free trials:

• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Billing: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• Cancellation: You can manage and cancel subscriptions in your Apple ID account settings
• No Refunds: No refunds are provided for partial subscription periods
• Apple App Store: Subscriptions and payments are handled by Apple
• Payment Processing: RevenueCat is used for subscription management

You acknowledge you have read our Privacy Policy regarding payment data.

3. Photo Deletion - YOU ARE RESPONSIBLE

ClearSpace helps identify photos, but YOU decide what to delete:

• You must review ALL photos before deletion
• Deleted photos may NOT be recoverable permanently
• We recommend backing up important photos first
• ClearSpace is NOT responsible for:
  • Accidental deletions
  • Loss of irreplaceable memories
  • Device storage issues
  • Data loss from any cause

4. Acceptable Use Policy

You agree to use ClearSpace only for lawful purposes:

• Do not attempt to gain unauthorized access
• Do not violate any local, state, or federal laws
• Do not use for harassment, abuse, or illegal activity
• Do not interfere with App functionality
• Do not create derivative works
• Do not bypass security features

5. Intellectual Property

All ClearSpace content, code, features, and functionality are owned by Alquimia Studio and protected by copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without written permission.

6. Disclaimer of Warranties

ClearSpace is provided "AS IS" without any warranties, express or implied:

• No guarantee of error-free operation
• No guarantee of availability or uptime
• No guarantee of specific results
• No guarantee regarding photo accuracy
• No medical or professional advice provided

7. Limitation of Liability

To the maximum extent permitted by law:

ClearSpace is NOT liable for:

• Data loss from deletion
• Loss of revenue or profits
• Loss of business opportunity
• Lost data or corrupt files
• Device damage or malfunction
• Indirect, incidental, or consequential damages

• 🇺🇸 USA: These limitations comply with common law in all US states
• 🇨🇦 Canada: These limitations comply with provincial consumer protection laws

8. Accessibility (ADA Compliance - USA)

ClearSpace is committed to accessibility for users with disabilities. We comply with Americans with Disabilities Act (ADA) standards. If you encounter accessibility issues, please contact us.

9. Jurisdiction & Governing Law

These Terms are governed by:

• 🇺🇸 USA Users: Laws of Washington State, USA (excluding conflicts of law)
• 🇨🇦 Canada Users: Laws of Ontario, Canada (excluding conflicts of law)

You consent to exclusive jurisdiction in courts located in these territories.

If any provision is unenforceable, remaining provisions continue in effect.

10. Dispute Resolution

Before litigation:

1. Contact us in writing about the dispute
2. Provide 30 days for resolution
3. Either party may pursue legal action if unresolved

Arbitration may be required depending on jurisdiction.

11. User Accounts & Security

You are responsible for:

• Maintaining account security
• Protecting your credentials
• Preventing unauthorized access
• All activities on your account
• Accurate information provided

12. Termination

We may terminate or suspend your access:

• For violation of these Terms
• For violation of App Store/Play Store rules
• For illegal activity
• For any reason with notice

Your license immediately terminates upon termination.

13. Changes to Terms

We may update these Terms at any time. We will notify you by updating the "Last updated" date. Continued use after changes constitutes acceptance. Review this page regularly for updates.

14. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and ClearSpace. They supersede all prior agreements and understandings.
